Welcome to Eddie. These Terms of Service ("Terms") govern your access to and use of our website, services, and related content provided by Eddie Safety, Inc. ("Eddie," "we," "us," or "our"). By accessing or using eddiesafety.com (the "Site"), you agree to these Terms. If you do not agree, please do not use the Site.
1. Purpose of the Site
Eddie provides information about our AI-powered pool safety system and offers opportunities to join our waitlist, beta program, or pilot program, receive updates, and contact our team. The Site is intended for informational and pre-launch engagement purposes only.
2. Eligibility
You must be at least 18 years old, or the legal age of majority in your jurisdiction, to use the Site or participate in any Eddie program.
3. Waitlist and Interest Programs
When you submit your information through any Eddie interest form or waitlist:
Submission does not guarantee participation, product availability, or future access. You agree to provide accurate and complete information. We may contact you via email or phone regarding updates, invitations, or program opportunities. You may opt out at any time by using the unsubscribe link in any email or contacting us at info@eddiesafety.com.
4. Product Safety Disclaimer
Eddie is an intelligent pool monitoring system designed to support water safety awareness and assist in early detection of potential distress. It is not a medical device, emergency service, or certified lifeguard replacement. Eddie is intended to supplement, not replace, active supervision by responsible adults or certified lifeguards.
No AI-based monitoring system can guarantee detection of every incident. Detection performance depends on camera placement, environmental conditions, lighting, water clarity, and system configuration. By using the Site or participating in any Eddie program, you acknowledge that Eddie does not assume liability for any drowning, injury, or emergency event occurring at any pool or facility, whether or not Eddie's system is in use. In any emergency, always contact 911 or local emergency services immediately.
5. Intellectual Property
All content on this Site, including logos, designs, text, graphics, and software, is owned by or licensed to Eddie Safety, Inc. and protected by copyright, trademark, and other applicable laws. You may not copy, reproduce, modify, or distribute any content without written permission. You may not use Eddie's name, logo, or design elements in any way that implies partnership or endorsement without prior written authorization.
6. User Conduct
You agree not to use the Site for unlawful, misleading, or harmful purposes; interfere with or disrupt the Site's functionality or security; or attempt to gain unauthorized access to any systems, data, or servers connected to the Site. We reserve the right to suspend or restrict access if we believe misuse is occurring.
7. Disclaimers
The Site and all related content are provided "as is" and "as available." We make no warranties, express or implied, regarding the accuracy, reliability, or completeness of the content; continuous or error-free operation of the Site; or the suitability of any information for a particular purpose. The Eddie system described on this Site is in active development and may change before release.
8. Limitation of Liability
To the fullest extent permitted by law, Eddie Safety, Inc. and its officers, employees, and affiliates are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site or reliance on its content. Your sole remedy for dissatisfaction with the Site is to stop using it.
9. Dispute Resolution
You and Eddie agree to resolve any dispute arising from these Terms or your use of the Site through binding individual arbitration under the rules of the American Arbitration Association, rather than in court. You waive any right to participate in a class action lawsuit or class-wide arbitration. Nothing in this section prevents either party from seeking injunctive or equitable relief in court for intellectual property violations.

The Site may include links to external websites or services operated by third parties. Eddie is not responsible for the content, practices, or policies of those sites. Access them at your own risk.
11. Indemnification
You agree to indemnify and hold harmless Eddie Safety, Inc., its affiliates, employees, and partners from any claim, liability, damage, or expense arising from your violation of these Terms or misuse of the Site.
12. Changes to These Terms
We may update these Terms periodically. The updated version will be posted here with a revised Effective Date. Your continued use of the Site after any update constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute not subject to arbitration under Section 9 shall be resolved in the state or federal courts located in Orange County, California.
